For his part, the president of the Senate Board of Directors, Gerardo Fernández Noronaaccused the Court of bringing the country to the brink of a constitutional crisis and warned that the Legislative Branch may reject such resignations.

“He Judiciary has rebelled, is in an attitude of frank provocation, rebellion, not of contempt, of absolute disobedience to the constitutional framework. “It is one step away from taking the country to a very delicate situation of constitutional crisis, because it lacks the powers,” he noted.

Likewise, he criticized the project González Alcántara Carrancá and considered that it is a “sample of the rebellion of the members of the Court”, which is why he opened the possibility of rejecting their resignations and thereby preventing them from receiving retirement benefits when they leave their positions on August 31.

Nevertheless, Fernandez Norona He ruled out the possibility of initiating a political trial against the ministers who vote in favor of González Alcántara Carrancá’s project: “it is not the way.”

Meanwhile, the leader of Morena in the Chamber of Deputies, Ricardo Monrealreiterated that the Senate has the possibility of rejecting the resignations of the ministers and leaving them without retirement benefits.

Interviewed in San Lázaro, he acknowledged that the reform to Judiciary grants ministers the possibility of resigning from office as a condition of preserving their retirement benefits.

However, he noted that the senators will determine whether to accept the resignations of the judges.

“The Senate is responsible for reviewing and accepting the resignation. The hypothesis may arise, as has happened in history, that they do not accept it and, if they do not admit it, they will be left without retirement benefits until August,” he pointed out.

Separately, the Morenoist legislator Dolores Padierna He described it as “lack of ethics” for the ministers to “charge” their retirement benefits to the people of Mexico.

“It is truly a lack of political ethics. They are public servants, the people pay them with taxes,” he stressed.

According to him, these include three armored vans with drivers, booths, gasoline, food, groceries and 42 other privileges.

58% decline in unsacculated

The Senate reported this Monday that so far 412 members of the Judiciary have declined to participate in the election on the first Sunday of June 2025.

One day after the end of the notification period to decline, 157 judges and 255 magistrates—of the 711 who were unimpeached—decided not to participate in the process.

According to the call, the members of the Judiciary must seek to remain in office as long as they submit to the election.
