The minister Lenia Batres Guadarrama warned that if Supreme Court of Justice of the Nation (SCJN) redirects the pending consultations that seek to stop the judicial reform would be giving a authentic coup d’état.
At the beginning of the session, Batres joined the position of Loretta Ortiz and Yasmin Esquivelwho ruled to reject the pending queries presented by federal judges.
“The Supreme Court would be giving a real, and I mean it with all its letters, coup d’étatby attempting to subject to constitutional control the work of the constitutional reforming power that has participated in the process of constitutional reform in matters of judicial power.
“… Therefore, the attempt to attribute meta-constitutional powers to this Supreme Court for the purpose of subordinate to the other powers of the Union and even to the constitutional reforming power, emerging as an authentic supreme conservative power, which not even in the best times of conservatism in the 19th century concentrated such power, completely ignoring the principle of separation of powers and constitutional supremacy.
In the current session, three ministers have spoken in favor of the minister’s project Juan Luis González Alcántaraso they would add four votes in favor; they need one simple majority of six votes.
The ministers who have said they are in favor of the project are: Javier Laynez Potisek, Luis María Aguilar and Minister Margarita Ríos Farjat.
