He Official Gazette of the Federation (DOF) published a preliminary resolution of the administrative investigation procedure antidumping ex officio on imports of footwear originating from the People’s Republic of China, regardless of the country of origin, and imposed provisional compensatory duties
TheSecretary of Economy (SE) indicated that the administrative procedure of ex officio investigation into unfair international trade practices continues, in its form of price discrimination, and the following provisional ad-valorem compensatory duties (on value) are imposed on imports of footwear originating in Chinaregardless of the country of origin.
The compensatory fees remained in 17.99 percent for imports from the Apache Footwear company; 17.59, for Bidibi Shoes; 12.13 for Xinlong Footwear; 13.79 for imports from the other export-producing companies that appeared and were not selected.
Also 17.99 percent for the company’s imports Yaxin Shoes Factory and other exporting companies.
He DOF explained that the validity of the provisional compensatory duties established will be four months from the day this resolution comes into force and will apply to the customs value declared in the corresponding customs declaration.
“Importers who, pursuant to this resolution, must pay provisional compensatory duties, will not be obliged to pay them if they verify that the country of origin of the merchandise is different from China”he explains.
“The verification of the origin of the merchandise will be carried out in accordance with the provisions of the agreement that establishes the rules for determining the country of origin of imported merchandise and the provisions for their certification, for non-preferential purposes,” he adds.
Furthermore, the Ministry of Economy granted a period of 20 business days, so that the interested parties appearing in the procedure, if deemed appropriate, appear before the secretariat to present the arguments and additional evidence that they deem relevant.
He specified that these will count from the day the resolution comes into force.
