The Specialized Room Electoral Court closed the largest file they have ever had in their charge, related to 126 complaints against Morena’s presidential candidatesby thousands of fences, billboards and publications on social networks since 2022, but which concluded that for the most part, they could no longer resolve because they exceeded the legal expiration period.
Unanimously, the Specialized Regional Chamber of the Electoral Tribunal of the Judicial Branch of the Federation (TEPJF) closed the file that had been pending for more than two years, against Claudia Sheinbaum, Adán Augusto López, Marcelo Ebrard, Ricardo Monreal, Manuel Velasco and Gerardo Fernández Noroña, against whom the opposition filed more than a hundred complaints for the propaganda that was placed throughout the country as part of Morena’s internal process to elect its presidential candidate.
The ruling concluded that There were none of the electoral crimes denounced by the opposition, because in the walls, publications on social networks and propaganda, the intention to call for voting in the face of the federal electoral processso advance pre-campaign and campaign events cannot be accredited.
“They also did not exceed the limits of the law because they were part of a valid extraordinary process, which is part of the internal party life. Nor is there evidence of improper use of public resources because they did not seek to position people who were in public service.”
They pointed out that in addition, in the majority of the complaints, they can no longer even be resolved because the expiration of the one-year jurisprudential line has already applied, since these were presented since 2022, that is, it has already been more than two years. Therefore, they indicated that this was due to the fact that “different periods of inactivity were observed without any justification” on the part of the Technical Unit for Electoral Litigation of the INE to advance the investigations and change the file.
The acting magistrate and rapporteur of the matter, Monica Lozano Ayalaexplained that it is the largest and most complex file of the Specialized Chamber, since it involved the receipt of 126 complaints and 39 precautionary measures.
That these ended in 118 volumes with a thousand pages each, that is, 1,180 thousand pages of file, with more than two thousand detailed records, 601 events of the presidential candidates were analyzed, more than seven thousand fences were reviewed, they delivered 89 devices with information and a total of 338 people linked to this propaganda were reported.
The three magistrates of the Specialized Room recognized the work of those who participated in receiving the information they received from the Electoral Litigation Technical Unit and the analysis to review the file.
However, they pointed out that the legal expiration was applicable, so following the jurisprudential line established a few weeks ago by a majority vote of the Superior Chamber of the Electoral Tribunal of the Judicial Branch of the Federation, the receipt of each complaint should be considered to account for the period of one year to resolve, and not the last complaint on the file. Which in this case, even exceeds double the expected period.
The opposition may still challenge the matter before the Superior Chamber of the Electoral Tribunal of the Judicial Branch of the Federation for a final ruling.
